These Terms of Use ("Terms") govern your use of Velocity, a live video platform provided by Kevin Klein, Gronau (Westfalen), Germany ("Velocity", "we", "our", or "us"). Full provider details are available in the Imprint. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
Velocity offers three modes for going live: Interactive Sessions, Live Streaming, and Interactive Live Streaming. Around them is a workspace that can include Cloud storage, a Whiteboard, a Workspace, and an in-browser IDE. Velocity is actively maintained, and features may change as the service improves.
Velocity Lab is not part of the production service and is provided for demonstration and testing only.
You must be at least 18 years old and able to enter into a binding contract to use Velocity. By using the service, you confirm that you meet these requirements. Velocity is not intended for, and may not be used by, anyone under 18.

Velocity is a platform for legitimate live video. The following are strictly prohibited in any session, stream, recording, upload, chat, or other content on Velocity, whether public or private.

Velocity has zero tolerance for any content that sexualises, exploits, or endangers minors. The following are strictly prohibited and are never permitted under any circumstances:
We report such content and conduct to law enforcement, terminate the accounts involved, and preserve and disclose relevant information to the competent authorities.
The Host controls recording and streaming. If you are a Host, you must not:

If you become aware of prohibited or illegal content on Velocity, report it to legal@velocitystreaming.io. We review reports and take appropriate action, including the enforcement steps below.
To enforce these Terms and protect people, we may, at our discretion and where lawful:

You can stop using Velocity at any time. We may suspend or terminate access if you breach these Terms, misuse the service, create legal or security risk, or where required by law. We will act proportionately and, where appropriate, give notice unless urgent action is required.
The Host of a session or stream controls it. If you are a Host, you are responsible for:
If you use Velocity for business or professional purposes (for example with your guests, customers, students, or team members), you are responsible for your own legal basis, notices, consents, and data protection obligations towards those people, and for their conduct in your sessions. Where we process personal data on your behalf, the Data Processing Agreement applies.
If you join a session or watch a stream, you agree to behave lawfully and respectfully and to follow the Host's reasonable instructions. Sessions may be recorded or streamed by the Host. If you do not agree to the Host's recording or streaming setup, do not join, or leave the session.
You keep ownership of the content you create, stream, upload, or share through Velocity. You grant us the limited rights needed to host, process, transmit, and deliver your content for the purpose of providing the service (for example storing a recording, delivering a live stream, or saving a file you upload). You are responsible for your content and for having the rights needed to use it.
If you restream to a third-party platform (for example via a destination you configure), that platform is controlled by you and governed by its own terms and policies. We are not responsible for third-party platforms.
Velocity does not currently charge for the service. There is no active paid checkout, and no subscription is created or renewed today. Paid plans will only apply after explicit signup and checkout terms are presented to you and you accept them; those terms will then form part of these Terms.
We work to keep the service available and reliable, but we do not promise uninterrupted or error-free operation and do not offer a specific uptime or service-level guarantee. As the service is actively maintained, we may change, suspend, or discontinue features. We will give reasonable notice of significant changes where we can.
To the extent permitted by law, the service is provided "as is" and "as available". Our liability is governed by the following, which apply in addition to your statutory rights:
If you use Velocity for business or professional purposes, you agree to hold us harmless from third-party claims arising from your content or your breach of these Terms or applicable law, to the extent you are responsible for them.
Our handling of personal data is described in the Privacy Policy. Where we process personal data on your behalf as a processor, the Data Processing Agreement applies.
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection granted by mandatory provisions of the law of your country of habitual residence. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
We may update these Terms as the service develops. We will post the updated version on this page and change the "Last updated" date. For material changes, we will take reasonable steps to notify you and, where required by law, ask for renewed acceptance.
